These Terms of Service (“Terms”) govern your use of new-game-gear.com (the “Site”) and any purchase you make from New Game Gear (“New Game Gear,” “we,” “us,” or “our”). By using the Site, creating an account, subscribing to our emails, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to place an order. If you create an account, you are responsible for keeping your login details secure and for activity under your account. Please give us accurate, current information.
2. Products and pricing
- We try to describe and photograph products accurately, but colors, sizes, and details may vary slightly from what you see on screen.
- Prices are shown in U.S. dollars and may change at any time without notice. Taxes and shipping are calculated at checkout.
- If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel orders for that product and refund any payment.
- Products are subject to availability. We may limit quantities or discontinue products at any time.
3. Orders and payment
Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, for example because of suspected fraud, a pricing error, or lack of stock; if we cancel after you have paid, we will refund you in full. Payment is processed by third-party payment processors, and you confirm you are authorized to use the payment method you provide.
4. Shipping
- We ship worldwide. Many products are shipped directly from our fulfillment partner’s warehouses, so items in one order may arrive in separate packages.
- Delivery estimates shown at checkout or in emails are estimates, not guarantees. Carrier delays, customs, and holidays can add time.
- Free shipping applies to qualifying orders over $75, as shown at checkout. Where free shipping is not offered, shipping costs are shown before you pay.
- International orders may be subject to customs duties, import taxes, or fees, which are the buyer’s responsibility unless stated otherwise at checkout.
- Risk of loss passes to you when the carrier delivers your order. If tracking shows delivered but you cannot find your package, contact us within 7 days and we will help with the carrier claim.
5. Returns and refunds
- 30-day returns: you may return most items within 30 days of delivery. Items must be unused, in original condition, and in the original packaging with all accessories.
- How to start a return: email support@new-game-gear.com with your order number and the item you want to return. We will send return instructions. Returns sent without contacting us first may not be accepted.
- Return shipping: unless the item is damaged, defective, or we sent the wrong item, return shipping costs are paid by you and original shipping charges are not refundable.
- Damaged, defective, or wrong items: contact us within 30 days of delivery with photos. We will offer a replacement or a full refund, including shipping.
- Refunds: once we receive and inspect your return, approved refunds are issued to your original payment method, usually within 10 business days. Your bank may take additional time to post the credit.
- Non-returnable: gift cards, items marked final sale, and items that are used, damaged by misuse, or missing parts.
6. Promotions and discount codes
Discount codes (for example, first-order codes) are limited to one use per customer unless stated otherwise, cannot be exchanged for cash, and may not be combined with other codes unless the offer says so. We may change or end a promotion at any time, and we may cancel orders that misuse a promotion.
7. Emails and subscriptions
If you subscribe to our emails, including through Google Reader Revenue Manager or any sign-up form on the Site, you agree to receive marketing messages from New Game Gear. You can unsubscribe at any time using the link in any email. We will still send transactional messages about your orders.
8. Acceptable use
You agree not to:
- use the Site for any unlawful or fraudulent purpose;
- attempt to interfere with, damage, or gain unauthorized access to the Site or its systems;
- scrape, copy, or harvest content or data from the Site using automated means without our written permission; or
- post reviews or other content that is false, abusive, infringing, or unlawful.
9. Reviews and content you submit
If you submit reviews, photos, comments, or other content, you give New Game Gear a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with the Site and our marketing. You confirm you have the right to share it. We may remove content at our discretion.
10. Intellectual property
The Site and its content, including text, graphics, logos, images, and the New Game Gear name, belong to New Game Gear or its licensors and are protected by intellectual property laws. You may not use them without our written permission. Third-party brand names and trademarks belong to their owners.
11. Third-party links and services
The Site may link to or use third-party services, such as payment processors, carriers, Google, and social media platforms. We are not responsible for their content, policies, or practices, and your use of them is subject to their terms.
12. Disclaimers
The Site and products are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any manufacturer warranty that comes with a product is provided by the manufacturer. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
13. Limitation of liability
To the fullest extent allowed by law, New Game Gear will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
14. Indemnification
You agree to defend, indemnify, and hold harmless New Game Gear from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.
15. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction, except where your local consumer law gives you the right to bring a claim in your home courts.
16. Changes to these Terms
We may update these Terms from time to time. The updated version applies from the effective date shown at the top of this page. Continuing to use the Site after changes means you accept the updated Terms.
